I think the rider knew it was a cop from the start, but in general, yeah, that's not a smart thing to do (on the cop's behalf). And why pull his gun on a traffic stop.. of a MOTORCYCLIST where you can clearly see the rider's hands at all times? Would he really have shot the biker if the biker had tried to run? Really? You're gonna kill a person for running from a traffic stop?

That would have ended alot worse if I was the rider.  If someone gets out of an undercover (theres a difference between undercover and unmarked cars) car, wearing plain clothes that don't identify him as law enforcement, and draws a gun on me....

I would have drawn mine.

They were trying to change the riders original charge from speed to ....."State police saw the video online, reopened the investigation and turned Graber's traffic ticket into reckless and negligent driving charges"........ and are trying to charge him with unlawful recording which is a felony.

It was in those links but the media had it copyrighted so I just posted links. Yeah he's military reserves and state police "saw it on utube" so now they came to house confiscated his computers and he may get 5 years in prison. In Maryland u can't record a person "audiably", and all parties must agree/be aware. I believe this case may make history.

I'm guessing the marked unit had a dashcam so by default I'd say all parties knew. The state Police are backing the officer. That's why put helmet cam in the title.

not sure but... I believe you can record what ever you want for your personnel use but when you record someone without their consent and you post it for the public to see then you are wrong

F.S. 934.03 934.04

I thought the supreme court had ruled a/v recording in public was legal. I can't find documentation of it via case law. I thought the media and citizens rights were all through the 1st amendment. How often does the media ask everyone for consent when they are recording? His camera wasn't hidden and it was obvious.

I said I wasnt sure and i really dont care just making a comment
and F.S. stands for Florida Statute and this was in Maryland. State laws are different and according to the media in the post earlier i could have sworn i heard them say it is against the law in Maryland
